Terms & Conditions

These terms form the agreement between you and Habit of the Day. Please read them before using the app.

1. Acceptance of These Terms

By creating an account, or by accessing or using Habit of the Day (the “Service”), you agree to these Terms & Conditions and to our Privacy Policy. If you do not agree, please do not use the Service.

2. Eligibility

You must be at least 13 years old to use Habit of the Day. If you are under the age of majority where you live, you may only use the Service with the consent of a parent or guardian who agrees to these terms on your behalf.

3. Your Account

You are responsible for:

  • Keeping your password and authentication credentials confidential.
  • All activity that happens under your account.
  • Providing accurate and current information, including a valid email address.
  • Telling us promptly at support@habitoftheday.com if you believe your account has been compromised.

One person may not maintain multiple accounts to circumvent plan limits or promotions.

4. The Service

Habit of the Day is a consistency-focused habit tracking application. Instead of streaks, it measures a Consistency Score, and includes Grace Days, Tiny Habit fallbacks, flexible frequencies, reminders and a habit discovery feed.

Free

The Free plan includes core habit tracking with a limit on the number of active habits, the Discover feed, reminders, and history browsing.

Pro

Pro unlocks unlimited habits, advanced insights and heatmaps, and retroactive editing of past days (ticking off habits and editing notes in your history). Current plan features and prices are shown on the pricing page. We may add, change or remove features over time.

5. Subscriptions, Billing and Cancellation

  • Pro is offered on a monthly or annual subscription.
  • Subscriptions renew automatically at the end of each billing period at the then-current price, until you cancel.
  • You can cancel at any time. Cancellation takes effect at the end of the current billing period, and you keep Pro access until then.
  • Except where required by law, payments are non-refundable and we do not provide partial or pro-rata refunds for unused time.
  • Billing, payment methods and invoices are handled by Stripe. We do not store your full card details.
  • If a payment fails, we may retry it and may suspend Pro features until payment succeeds.
  • We may change prices with reasonable advance notice; changes apply from your next renewal.
  • Where you purchased through the Apple App Store or Google Play, that store's billing and cancellation rules apply and you must cancel through your store account.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in breach of any applicable law.
  • Reverse engineer, decompile or attempt to derive the source code of the Service, except to the extent this restriction is prohibited by law.
  • Attempt to access another user's account or data, or bypass authentication or access controls.
  • Scrape, crawl or harvest content or data from the Service without our written permission.
  • Interfere with or disrupt our infrastructure, including denial-of-service attempts, load testing or probing without authorisation.
  • Harass, abuse or threaten other users, our team, or anyone else.
  • Send spam or unsolicited messages through the Service.
  • Upload or transmit malware, viruses or other harmful code.
  • Use bots, scripts or other automation to access the Service, other than our documented agent integration used with your own account.

7. Your Content

You retain ownership of the content you create — your habits, completions, notes and profile details. You grant Habit of the Day a limited, worldwide, royalty-free licence to host, store, back up, transmit and display that content solely so that we can operate and provide the Service to you. This licence ends when you delete the content or your account, subject to normal backup rotation.

If you choose to publish a habit to the community Discover feed, you grant us a licence to display that habit to other users.

8. Intellectual Property

The Habit of the Day name, logo, branding, design, user interface, software, and all site and app content (other than your own content) are owned by Habit of the Day and protected by intellectual property laws. You may not copy, modify, distribute, sell or create derivative works from them without our prior written consent.

9. Availability and Changes

We work to keep the Service available, but we do not guarantee uninterrupted or error-free operation. The Service may be unavailable during planned maintenance, upgrades, or because of factors outside our control, including failures at our hosting or notification providers.

We may modify, suspend or discontinue features at any time. Where a change materially reduces paid functionality, we will give reasonable notice.

10. Disclaimers

Habit of the Day is a self-improvement tool. It is not:

  • Medical advice or a medical device.
  • Mental health treatment, therapy or crisis support.
  • Professional healthcare of any kind.
  • Financial, legal or other professional advice.

Always seek advice from a qualified professional before making decisions about your health. If you are in crisis, contact your local emergency services.

11. Limitation of Liability

To the fullest extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied.

We are not liable for:

  • Reminders or push notifications that are delayed, undelivered or missed.
  • Loss of, or corruption to, data.
  • Business interruption or loss of profits, revenue or goodwill.
  • Indirect, incidental, special, consequential or punitive damages.

Where liability cannot be excluded, our total aggregate liability is limited to the greater of the amount you paid us in the 12 months before the claim, or GBP 50. Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law. If you are a consumer, your statutory rights are unaffected.

12. Suspension and Termination

You may stop using the Service at any time and delete your account from the Delete Account page. We may suspend or terminate an account that breaches these terms, creates risk or legal exposure, or is used fraudulently. Where practical and lawful, we will give notice first.

13. Governing Law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute, except that consumers may bring proceedings in the courts of their country of residence where local law allows.
